General Terms and Conditions

General Terms and Conditions apply to: Loser Bergbahnen GmbH & Co KG, hereinafter referred to as "Loser Bergbahnen" for short.

I. Ski tickets in general

1. use of ski tickets

Ski tickets are personal and non-transferable. Only persons with a valid ski ticket will be transported.
Subsequent exchanges or extensions of the validity period are not permitted. The resale of ski passes and vouchers is prohibited.
By accepting the ski pass, the customer agrees to automatic registration or personalised, photographic recording, storage and processing of their personal data for control purposes. At the request of our employees, the holder must present the ski pass and identify themselves.
Any misuse of ski tickets (passing them on to third parties, giving incorrect age categories, etc.) will result in the ski ticket being withdrawn and the customer being denied boarding. In addition, a fine of € 50.00 plus the value of a day ticket at full price must be paid.
We reserve the right to press charges on suspicion of obtaining a service (§ 149 StGB) or fraud (§ 146 StGB).

2. winter sports ticket

By purchasing a winter sports ticket, the purchaser agrees to the General Terms and Conditions of Loser Bergbahnen GmbH & Co KG. The winter sports ticket is personal and non-transferable. Only persons with a valid winter sports ticket are entitled to use the infrastructure (car park, panorama road, winter hiking trail,...) of Loser Bergbahnen GmbH & Co KG. Checks are carried out by the staff of Loser Bergbahnen GmbH & Co KG. Persons found without a valid winter sports ticket must purchase a replacement winter sports ticket. With the purchase of the replacement winter sports ticket, the customer agrees to automatic registration or personal photographic recording, storage and processing of personal data. If the person is found a second time without a winter sports ticket during a check, a civil law suit will be filed. Any misuse of winter sports tickets (passing on to third parties,...) will result in the withdrawal of the winter sports ticket.

3. violations and refunds

Upon return of the undamaged ski tickets, the retained deposit (NOT included in the lift price) will be refunded.
Accidents resulting in injury must be reported to us immediately. Only in the event of an accident to the ski pass holder which makes further use of the ski pass impossible can a refund be made. In the case of sports injuries with a medical certificate from a local doctor and immediate deposit of the ski ticket, the refund of the unused ski ticket service (from the following day) is guaranteed. Refunds are only granted to injured persons, not to their relatives or fellow travellers and not in the event of illness.
Early departure, illness and circumstances within the customer's sphere of influence do not entitle the customer to a refund. No refunds will be granted for day ski tickets, in the event of bad weather, suspension of operations, slope closures, closure of individual lifts, illness, early departure or interruption.
In the case of refunds for Schneebären Cards, the proportional sales price is deducted for each day used.
A refund after 28 February is excluded.

We charge a fee of € 150,- for the rescue of injured persons.

4. shutdown

Heavy snowfall, natural hazards (avalanche danger, storm, bad weather...), official orders (e.g. in case of danger of epidemic, epidemic, pandemic), unforeseen technical defects and safety reasons may result in the closure of facilities or pistes. These closures do not entitle the holder to any price reduction or refund of purchased ski tickets.

5. piste closure

All pistes are closed from 5.00 pm to 8.30 am. For your skiing pleasure, piste preparation and snowmaking work is carried out during this period. During this time it is dangerous and forbidden to use the ski slopes and routes!
No rights whatsoever can be acquired by skiing on and using areas outside the marked and prepared ski runs. Any use of the open ski area is at your own risk.

6. compulsory wearing of helmets

Children up to 15 years of age are obliged to wear a helmet.

7. reductions

Discounts on ski tickets are only granted on presentation of valid photo identification.

II. ski tickets voucher system

1. validity

The Loser Bergbahnen offer a voucher system for the purchase of value vouchers and voucher packages. The vouchers can be redeemed after purchase at the Loser Bergbahnen ticket offices.

2. conditions of purchase and delivery

a) The vouchers issued by Loser Bergbahnen can be purchased by paying by credit card or by instant bank transfer and printed out at home. The contract is concluded with Loser Bergbahnen, which is also the clearing partner.
b) The vouchers only become valid after full payment of the amount. Value vouchers do not include VAT due to the non-allocability of the service content. The ordered or purchased vouchers cannot be redeemed in cash, transferred or resold to third parties.
c) The customer can only book and redeem the vouchers at the Loser Bergbahnen. All businesses listed in the voucher shop receive protected access to the "voucher system" and can thus directly validate the vouchers offered by them by entering the printed barcode.
d) Only the value of the voucher will be charged to the Loser Bergbahnen; any consumption in excess of the value of the voucher is to be settled directly between the customer and the communicated partner businesses. If the entire value of the voucher has not been consumed, the customer is left with the remaining amount on the voucher. The voucher with the remaining amount can, but does not have to, be reprinted. A refund of the remaining amount on the part of Loser Bergbahnen is excluded. As of the redemption of the vouchers, the respective valid General Terms and Conditions as well as the General Tariff Conditions (contractual conditions) of the Loser Bergbahnen apply.
e) Only natural and legal persons of full legal capacity are entitled to order vouchers.
f) Until the vouchers have been paid for in full, they remain the property of Loser Bergbahnen. The customer may therefore not dispose of them until this time and shall bear the risk of loss, destruction and deterioration from the time of payment. In the event of loss, theft or damage (illegibility of the voucher code or voucher number) to the vouchers, there is no entitlement to compensation.

3. return

You have the right to cancel this contract within fourteen days without giving any reason as long as the purchased voucher(s) have not yet been redeemed by the voucher provider. The revocation period begins from the day on which you or a third party named by you has taken possession of the goods or, in the case of partial deliveries, the last delivery. To exercise your right of withdrawal, you must inform the selling company of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or e-mail to the address info@loser.at). The amount will then be transferred to the account to be made known to Loser Bergbahnen (IBAN and BIC required). Only customers who are consumers within the meaning of the Austrian Consumer Protection Act may make use of the right of return.

4 Validity

The value vouchers purchased are valid for a period of 30 years from the date of issue in accordance with the ruling of the Supreme Court (2012). In the event of a price adjustment in the period between the purchase and redemption of the voucher, the difference to the currently valid ticket price must be paid.

5 Liability

Loser Bergbahnen accepts no liability for the redemption of vouchers by the respective partner businesses. The customer uses this website at his or her own risk. Loser Bergbahnen accepts no liability for damages arising from the use of this website. Loser Bergbahnen also accepts no liability for interruptions, technical failures, maintenance work, etc. Loser Bergbahnen will rectify any disruptions or failures as quickly as possible.

6. data protection

Loser Bergbahnen declares compliance with the Austrian Data Protection Act (DSGVO for short). Furthermore, Loser Bergbahnen declares that it will keep the data disclosed to it by the customer secret, insofar as there is no legally permissible reason for the transmission or disclosure of the data entrusted or to which access has been gained. In the case of online payment, data such as credit card number, bank code, account number are transmitted via a protected SSL line. The customer's details are processed automatically. The customer will only receive advertising information from the Loser Bergbahnen with separate consent.

7. copyright regulations

All news, graphics, design and logo of the Loser Bergbahnen website are exclusively for the personal information of the customer. They are used at the customer's own risk. All data of this offer enjoy the protection according to the provisions of the copyright law. Reproduction, copying and printing are permitted exclusively for the purpose of ordering a voucher. Any use beyond this exceeds the usual use and constitutes an infringement of copyright law.

8. place of jurisdiction

It is agreed that the exclusive place of jurisdiction shall be the court with subject-matter jurisdiction for the registered office of Loser Bergbahnen.

9. other provisions

Deviating, conflicting or supplementary General Terms and Conditions shall not become part of the contract. Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
